so today i emailed this guy and asked him if it was ok with him to file a claim...and not escalate it...he flipped his fucking lid and issued me a refund and everything...so now i feel bad

Should I? I paid $30 for this shit and never got it...part of me says no i shouldnt feel bad cuz i never got the shit, but another does feel bad cuz he did ship it (there is a tracking number and it was last scanned in toronto, an hour from me (on Nov 18), but from there its missing) and he has been very helpful during hte whole time

and to rub it in the guy types "HAVE A GOOD HOLIDAY!" at the end of the email sad

Granted this was a Canada Post issue...

But this is the bottom line -- the seller & you (the buyer) entered into an agreement to exchange funds for goods, that HE (the seller) didn't follow through with. You are owed the product in a timely manner, or a refund.

You got a refund.

It really is that simple. If he wants to be pissed about it, he's allowed. But it's not your fault or problem that Canada Post lost the package. It's HIS problem. He has to deal with that. Now that he's issued you a refund, if I were him i'd be raising hell to get a refund for a lost package Canada Post. Especially if it had tracking/insurance.

Sounds like the guy over reacted.  Why couldn't he just wait and see if it arrives, then you can close the dispute and nobody gets hurt???  Maybe email him again saying that?

Also make sure you always clear any funds sitting in your paypal account.  That way if you make a payment it comes direct off your credit card.  This allows you to do a charge back at a later date and it obviously doesn't matter if the time to lodge an ebay disupte is closed.
